Agreement to Terms

By accessing or using the GenXcelerate website (genxcelerate.com), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.

Description of Services

GenXcelerate provides AI education content, tools, and community access for experienced professionals. Our services include:

• A free resource library of practical AI guides for experienced professionals
• GenXcelerate, a free weekly newsletter delivered by email via Substack
• GenXcelerate Pro, a paid membership with premium content and resources
• The Next Act Audit, a paid self-guided or guided audit for individuals planning their next professional chapter
• The Operations Audit, a paid engagement for small businesses, and Report to Running, its optional 60-day implementation engagement

User Accounts

Some features require you to provide personal information such as your name and email address. You agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of any account credentials.

Acceptable Use

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable laws
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to our systems or interfere with our services
• Scrape, crawl, or use automated means to access our content without permission
• Reproduce, distribute, or resell our premium content without authorization

Intellectual Property

All content on this website, including text, graphics, logos, assessments, and course materials, is the property of GenXcelerate or its content creators and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

Paid Services and Refunds

GenXcelerate Pro memberships are billed at the rate displayed at the time of purchase. You may cancel your subscription at any time. Refund requests are handled on a case-by-case basis. Contact us within 30 days of purchase if you are not satisfied with a paid service.

The Operations Audit carries a stated guarantee that overrides the case-by-case policy above: if the audit cannot find you at least 5 defensible hours a week, measured against the baseline established in your pre-work and interviews and attached to named tasks and named tools or workflows, the full $999 is refunded. Pilots labeled as such do not count toward the five. The refund window for that guarantee runs 30 days from the day your report is delivered, not from the day of purchase.

Report to Running carries its own promise: hours returned are measured at day 60 against your audit baseline. If the three installed workflows fall short of the hours the audit attached to them, you receive two additional working sessions at no charge, and if they are still short at day 90, the net fee you paid for Report to Running is refunded. Where this section states a guarantee, that guarantee applies notwithstanding the general disclaimer of warranties below.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. GenXcelerate does not guarantee that AI tools, strategies, or recommendations discussed in our content will produce specific results for your business or career. Your results depend on many factors including your effort, expertise, and market conditions.

Limitation of Liability

To the fullest extent permitted by law, GenXcelerate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

Changes to These Terms

We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We will notify users of significant changes via our website or email.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of the state in which GenXcelerate operates.
